1. Who we are

Chatkin is an AI-powered product where a team of AI characters help you think through ideas and produce work such as documents, plans, and landing pages you can publish. These terms are a legal agreement between you and Chatkin ("we", "us", "our"). By creating an account or using the service, you agree to them.

2. Eligibility

You must be at least 16 years old to use Chatkin. By using the service you confirm that you meet this requirement. If you're using Chatkin on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

3. Your account

You're responsible for keeping your login credentials secure. You're also responsible for everything that happens under your account. Let us know immediately if you believe your account has been compromised.

4. What Chatkin is (and isn't)

Chatkin provides AI characters that help you brainstorm, work through problems, and produce artifacts such as documents, plans, mockups, and landing pages you can publish. The characters are software. Their output is not professional advice of any kind, whether legal, financial, medical, or otherwise. Do not rely on anything a Chatkin character says or produces as a substitute for qualified professional judgement.

5. Your content

You retain ownership of any content you submit to Chatkin, including files you upload. By using the service, you grant us a limited licence to store, process, and transmit your content to provide and improve the product. Running the service means sharing your content with the third-party providers that power it, including AI model providers and services for web search, audio transcription, and email, which process your content to generate responses. We do not sell your content or conversations to third parties.

6. Acceptable use

You agree not to use Chatkin to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Impersonate any person or entity
• Attempt to extract, reverse-engineer, or scrape the underlying models or infrastructure
• Circumvent rate limits, access controls, or security measures
• Use the service for any purpose that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these conditions.

7. Pages and content you publish

Chatkin lets you create and publish landing pages and similar content. You are responsible for anything you publish through Chatkin and for ensuring you have the right to publish it. If a page you publish collects personal information from visitors, such as email addresses, you are responsible for handling that information lawfully, including having a valid basis to collect it and telling visitors how it will be used. We provide the tools to build and host these pages; the content and how it is used are yours.

8. AI-generated output

Outputs from Chatkin characters are generated by AI models and may be inaccurate, incomplete, or outdated. We make no warranties about the accuracy or reliability of AI output. You are solely responsible for how you use or act on anything the characters say.

9. Intellectual property

Chatkin, its design, characters, and underlying technology are owned by us and protected by applicable intellectual property law. You may not copy, modify, distribute, or create derivative works from any part of the service without our written permission.

10. Availability and changes

We aim to keep Chatkin available but can't guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. Where material changes affect existing users, we'll give reasonable notice.

11. Disclaimer of warranties

Chatkin is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including fitness for a particular purpose, merchantability, and non-infringement to the fullest extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Chatkin, including loss of profits, data, or goodwill. Our total liability to you for any claim arising under these terms will not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of Chatkin, your content, or your breach of these terms.

14. Termination

Either party may terminate this agreement at any time. You can close your account by contacting us. We may suspend or terminate your access if you breach these terms, with or without notice depending on the severity.

15. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to these terms

We may update these terms from time to time. We'll notify active users of material changes. Continued use of Chatkin after changes take effect constitutes acceptance of the updated terms.
